Video Lottery terminal placements for a Retail Malt Beverage License must meet distancing requirements and be 2,000 feet away from any video lottery establishment, an elementary or secondary school, and City park boundaries. This distancing requirement does NOT apply to Retail Liquor Licenses.City of Sioux Falls Ordinances require that a CONDITIONAL USE PERMIT be approved for alcohol sales for any retail establishment or for those package establishments within 500 feet of an elementary or secondary school.

The Conditional Use Permit process is handled by the City Planning Office and is a land use, rather than a licensing matter. The Conditional Use Permit approval by the City Council will give you permission to conduct an alcohol sales land use at your specified location. Please contact the City Planning Office at (605) 367-8888 for information on the Conditional Use Permit.

You will still need to make application for the alcoholic beverage license(s). Upon receipt of your paperwork for a Conditional Use Permit by the City Planning Office, I will be contacting you to set up an appointment to review the paperwork that I will require for the alcoholic beverage license(s). NUMBER OF LICENSES available for Retail and Package Liquor is regulated by ordinance adopted by the City Council based on a State Law Formula. This formula is calculated using our last Federal Census numbers.

LEGAL DESCRIPTION shown on the application is the only area on the property where alcoholic beverages can be served/sold. If an applicant wishes to serve in their parking area, this must be included in the legal description. If the business is in a strip mall, the suite number or tenant space must be designated.
