Dance Hall Licenses

Club, lodge or organization dance means a dance conducted by a club, lodge or organization which has not been organized for the purpose of giving dances for profit and to which dance not only members of such club, lodge or organization, but other persons or friends in general without special invitation are admitted, whether an admission fee is charged or not. Where attendance at such dance is limited to members of such club, lodge or organization and specially invited friends, it shall be deemed a private dance.

Private dance means any dance not classified as a club, lodge, organization or public dance.

Public dance means any place or space open to public patronage in which dancing, wherein the public may participate, is carried on and to which admission may be had by the public by payment either directly or indirectly of an admission fee or price for dancing, for the personal gain or profit of the person conducting, maintaining, or operating such public dance or public dancehall. Any restaurant, cafe, club, nightclub or other place of business open to the public in which a cover charge or service charge is made or in which food or drinks or both are sold and served in or about such place to the public or entertainment or music provided therein for the public and either as an incident of such service or entertainment or music or in connection therewith the privilege of dancing therein is extended to the patrons thereof, either with or without a direct admission fee or price for dancing, shall be deemed a public dance, and the payment for service, food, drinks, music or entertainment by the patrons of any such place shall be deemed payment indirectly of a price for dancing for the personal gain or profit of the person conducting, maintaining, or operating such place. A public dance or public dancehall shall include any place where instrumental music, music by wire, by radio or by mechanical device, including a coin-operated machine, whether operated by the manager, employees of the place or patrons, and a space provided for dancing. The amounts paid for admission, refreshment, service or merchandise by the patrons of such place shall be deemed consideration for dancing. All dances given for profit, directly or indirectly, except as otherwise provided in this article, shall be deemed public dances.
