Peddler's Licenses

  • A ‘Peddler’ is any person traveling from place to place, house to house, or from street to street for the purpose of selling or soliciting for sale of goods, merchandise, or services and shall also include any person transacting a temporary business within the city.
    Exceptions:
    • Sale of agricultural products produced or processed in South Dakota.
    • Sales made by charitable, educational, or religious organizations which have registered with the City Clerk’s Office on forms provided by that office.
    • Traveling salespersons doing business exclusively with retail merchants.
    • Members of professions licensed by the state which have continuing education requirements.
  • It shall be unlawful for any person to engage in business as a peddler within the city of Sioux Falls without first obtaining a permit to do so.
  • Operating as a peddler without a City license is a violation of a City ordinance. The fine can be up to $200, 30 days in jail, or both.
  • It is unlawful for a peddler to engage in the business of peddling during the following times:
    • Between the hours of 8 p.m. and 9 a.m.
    • Any time on Sundays (unless invited back by the customer).
  • It is unlawful for a peddler to make false or fraudulent statements concerning the quality or nature of his goods or services.
  • A peddler must have his City license with him and must, upon request, display the permit. Failure to do so is unlawful.
  • It is unlawful for any peddler to enter upon any private premises when the premises is posted with a sign stating “No Peddlers Allowed,” “No Soliciting,” or words to that effect.
  • You should call the Sioux Falls Police Department at 367-7000 (non emergency) to report Peddler activity or if a Peddler will not show you his license.
