Date: 1/25/2008
From: City Clerk
Title: Public Notice: Charter Service

The City of Sioux Falls (Sioux Falls Transit) desires to provide charter service as defined below:

“Charter Service” means transportation of a group of persons who, pursuant to a common purpose, under a single contract, at a fixed charge for the vehicle, have acquired the exclusive use of the vehicle to travel together under an itinerary either specified in advance or modified after having left the place of origin.

Charter service provided by Sioux Falls Transit includes service seven days a week, 24 hours a day, within and up to three miles beyond the city limits of Sioux Falls, using buses and vans.

According to federal regulations, any private charter operator desiring to be considered willing and able to provide the charter service that the City desires to provide should submit written evidence to prove that it is willing and able within 30 days from the date of this notice.

The evidence necessary for the City to determine if you are willing and able includes the following:

  1. A statement that the private charter operator has the desire and physical capability to actually provide the charter service specified; and,
  2. A copy of the documents showing that the private charter operator has the requisite legal authority to provide the proposed charter service and that it meets all necessary safety certification, licensing, and other legal requirements to provide the proposed charter service.

All of the above-mentioned evidence should be sent to: City of Sioux Falls, Department of Planning, Attention: Transit Planner, P.O. Box 7402, Sioux Falls, SD 57117-7402.

The City will review only the evidence submitted by the deadline and shall complete its review within 30 days of the deadline for submittal. Within 60 days of the submittal deadline, the City will inform each private operator, that submitted evidence, what the results of the review are.

The City will not provide any charter service using equipment or facilities funded under the Federal Transit Act of 1964, as amended, if there is at least one willing and able private charter operator, unless one or more of the exceptions in 49 CFR Section 604.9(b) applies, including entering into an agreement with all willing and able private charter operators which permits the City to provide charter service directly to a customer.
