The Civil Rights Ordinance of the City of Sioux Falls declares that it is discrimination for an employer, because of:

- Color
- Sex
- Creed
- Religion
- National Origin
- Disability
To refuse to hire; To discharge an employee; Or to accord adverse, unlawful, or unequal treatment to any employee or applicant for employment who belongs to one of the above protected groups.

- Training
- Apprenticeship
- Tenure
- Promotion
- Upgrading
- Compensation
- Layoff
- Any other term or condition of employment (including sexual or racial harassment)
Types of Discrimination:
- Evil Intent -- Action causing economic harm to a person solely because of personal bias against the protected group of which the person is a member.
- Differential Treatment --Action causing economic harm to a person because of that person's race, color, sex, creed, religion, national origin, or disability which is different from the way an employer treats similarly-situated people. The treatment is illegal unless based upon a legitimate, nondiscriminatory reason.
- Discriminatory by Effect -- Practices fair in form and administered equally but have the result of excluding proportionately more members of a protected group than other groups, unless the result is unavoidable due to the essential operation of the business or is job-related.
